Acceptance of Terms

Agreement to Terms

  • By accessing or using Fizzly AI, you agree to these Terms of Service
  • If you disagree with any part of these terms, you may not use our services
  • You must be at least 18 years old to use our services
  • You are responsible for compliance with local laws and regulations

Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining account security
  • One account per person - no sharing or transferring accounts
  • You must notify us immediately of any unauthorized access

Services and Usage

AI Generation Services

  • Access to AI image generation using various models (Flux, etc.)
  • Video generation capabilities (WAN, Kling, Veo)
  • Image editing tools (face swap, image-to-image, upscaling)
  • Custom LoRA model training for personalized content

Credit System

  • All AI operations consume credits based on complexity
  • Credits are non-refundable once consumed
  • Unused credits do not expire unless account is terminated
  • Credit packages and pricing subject to change with notice

Marketplace Services

  • 90% revenue share for sellers, 10% platform fee
  • Instant access to purchased content upon payment
  • Sellers retain ownership of their created content
  • Marketplace listings must comply with content policies

Payments and Billing

Purchases and Subscriptions

  • All payments processed securely through Stripe
  • Prices listed in USD unless otherwise specified
  • Subscriptions auto-renew unless cancelled
  • Refunds granted only for technical issues preventing service use

Marketplace Transactions

  • Buyers purchase content using platform credits
  • Sellers receive 90% of sale price minus processing fees
  • Minimum payout threshold of $10.00
  • Payouts via Bank Transfer, Bitcoin, or USDC

Fees and Charges

  • 10% platform fee on all marketplace sales
  • 2.5% processing fee on payouts
  • No hidden fees - all costs displayed upfront
  • Currency conversion fees may apply for international transactions

Content and Intellectual Property

Your Content

  • You retain ownership of content you create
  • You grant us license to store and display your content
  • You are responsible for ensuring content doesn't infringe rights
  • We may use content for improvement and promotional purposes

Platform Content

  • Fizzly AI owns all platform software and designs
  • Base AI models remain property of their respective owners
  • You may not reverse engineer or copy platform features
  • Trademarks and logos are protected intellectual property

LoRA Models

  • You own the LoRA models you train
  • Models trained on copyrighted content are your responsibility
  • Selling models grants buyers perpetual usage rights
  • We store but do not claim ownership of your models

Prohibited Uses

Content Restrictions

  • No illegal content or activities
  • No non-consensual intimate images
  • No content involving minors
  • No harassment, hate speech, or violence

Platform Abuse

  • No automated scraping or data harvesting
  • No circumventing security measures or limits
  • No creating multiple accounts to abuse promotions
  • No interfering with other users' access

Marketplace Violations

  • No fraudulent listings or misrepresentation
  • No selling content you don't own
  • No price manipulation or fake reviews
  • No money laundering or financial crimes

Limitation of Liability

Service Availability

  • Services provided "as is" without warranties
  • No guarantee of uninterrupted service availability
  • Not liable for third-party service disruptions
  • Maintenance may cause temporary unavailability

Damages

  • Not liable for indirect or consequential damages
  • Total liability limited to amount paid in last 12 months
  • Not responsible for user-generated content
  • Not liable for lost profits or data

Indemnification

  • You indemnify us against claims from your content
  • You cover costs from your violation of terms
  • Indemnification survives account termination
  • We may defend ourselves at your expense

Account Termination

Termination Rights

  • Either party may terminate at any time
  • We may suspend accounts for terms violations
  • Severe violations result in immediate termination
  • No refunds for termination due to violations

Effect of Termination

  • Loss of access to all platform features
  • Marketplace listings removed from public view
  • Pending payouts processed per normal schedule
  • Content may be retained for legal compliance

General Provisions

Governing Law

  • Governed by laws of Delaware, United States
  • Disputes resolved through binding arbitration
  • Class action waiver applies to all claims
  • Small claims court available for qualifying disputes

Changes to Terms

  • We may update terms with 30 days notice
  • Continued use constitutes acceptance of changes
  • Material changes communicated via email
  • Previous versions available upon request
